Terms of Service
These Terms of Service ("Terms") govern your use of yoin (internal code name: casknote, the "App") and any related services (collectively, the "Service") operated by Shinya Yaginuma ("we", "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
In the event of any discrepancy between this English version and the Japanese version, the Japanese version shall prevail.
1. Eligibility (legal drinking age)
Because the Service deals with alcoholic beverages, it is intended only for users who have reached the legal drinking age in their country or region of residence (20+ in Japan). You must enter accurate information at the age-verification screen. If we learn that you are below the applicable legal drinking age, we may suspend or delete your account and related data.
2. Accounts
- Certain features require sign-in via Apple ID or Google account.
- You are responsible for safeguarding your account and may not transfer or share access with any third party.
- All activity under your account is deemed to be your activity.
- You may delete your account at any time via the in-app flow. Post-deletion handling is described in our Privacy Policy.
3. Prohibited conduct
You agree not to use the Service to:
- Violate any applicable law, regulation, or public order and morals;
- Infringe the intellectual property, privacy, publicity, or other rights of us, other users, or third parties;
- Defame, harass, threaten, or discriminate against others;
- Post content that is sexual, violent, abusive, deceptive, or otherwise objectionable;
- Impersonate any person or entity, or misrepresent your identity;
- Encourage or promote excessive drinking, underage drinking, drunk driving, or otherwise irresponsible alcohol consumption;
- Use the Service for advertising, solicitation, or any commercial purpose without our prior written consent;
- Distribute malware, attempt unauthorized access, reverse-engineer the Service, scrape, or use automated tools that place excessive load on the Service;
- Otherwise interfere with the operation or reputation of the Service.
4. User content
You are solely responsible for any content you submit, post, upload, or share through the Service ("User Content"). We make no warranty as to the accuracy, legality, or usefulness of User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, publicly transmit, display, and modify (including resizing and format conversion for service operation) such User Content for the purpose of providing, improving, promoting, and operating the Service. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe any third-party rights.
We may remove or hide User Content that we believe violates these Terms or applicable law, with or without prior notice. For information about how User Content is shared publicly within the Service, see our Privacy Policy.
5. Reporting and moderation
You may report content or behavior that you believe violates these Terms via the in-app reporting feature. We may, at our discretion, review reports and take action including removing content, warning users, restricting access, or terminating accounts.
6. Intellectual property
All rights in and to the Service (including software, text, images, logos, trademarks, databases, and know-how) are owned by us or our licensors. Except for the license to User Content described in Section 4, these Terms do not transfer any rights to you.
7. Suspension and termination
We may, with or without notice, suspend or terminate your access to all or part of the Service, remove your User Content, suspend or delete your account, or take other measures if you violate these Terms, provide false information, fail to meet the eligibility requirements, fail to respond to our inquiries, or in any other case we deem inappropriate.
8. Service changes and discontinuation
We may, with or without notice, modify, add, discontinue, suspend, or terminate all or part of the Service. Except where otherwise required by law, we are not liable for any resulting damages.
9. Disclaimer; limitation of liability
The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, security, and non-infringement.
Except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages arising out of or in connection with the Service. Where we are liable, our aggregate liability shall be limited to the amount actually received by us from you during the twelve (12) months preceding the event giving rise to liability, and in any case to direct and ordinary damages only.
Disputes between users or between you and third parties are your responsibility to resolve; we are not a party to them.
10. Responsible drinking
The Service does not encourage alcohol consumption. You are responsible for drinking responsibly and in compliance with applicable laws. Pregnant or nursing individuals, minors, and people advised by a doctor to abstain should not consume alcohol. Drunk driving is strictly prohibited.
11. Changes to these Terms
We may amend these Terms at any time. When we do, we will announce the amended Terms and the effective date in the App or on this page. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.
12. Notices
We may communicate with you via in-app notices, postings on the Terms page, emails sent to your registered address, or any other reasonable means.
13. Severability
If any provision of these Terms is held invalid or unenforceable by applicable law (including Japan's Consumer Contract Act), the remaining provisions shall continue in full force.
14. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
15. Governing law and jurisdiction
These Terms and the Service are governed by the laws of Japan. Any dispute arising out of or in connection with the Service or these Terms shall be submitted to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court of first instance, depending on the amount in controversy.
